Law of July 30, 2018, on the Protection of Trade Secrets was published in the official journal on August 14, 2018 and entered into force on August 24, 2018.
This law implements Directive (EU) 2016/943 of the European Parliament and of the Council of 8 June 2016 on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure, which aims to harmonize and improve the protection of trade secrets in all the Member States of the European Union.
In addition, it makes changes to the Code of Economic Law, the Judicial Code and the Law of July 3, 1978, on Employment Contracts which provide, inter alia, for i) the creation of new legal actions, including the cessation of the use or unlawful disclosure, recall of property, destruction of the infringing property or its delivery to the holder and holder, payment of financial compensation for the damage suffered by the holders and holders of the trade secret, etc .; and ii) the protection of the confidentiality of business secrets throughout legal proceedings.
